What happens if you tow over capacity in Australia?

Towing over your vehicle's braked towing capacity, GVM or GCM is an offence under the Heavy Vehicle National Law and equivalent state acts. Penalties range from on-the-spot fines of $200 for minor breaches to court-imposed fines of $10,000+ for severe breaches, plus 3 demerit points, a defect notice that can ground your rig on the spot, and the very real risk your insurer will refuse to cover any incident that occurs while you're overloaded.

Will my insurance cover me if I tow over capacity?

Most Australian comprehensive and third-party policies have an exclusion for vehicles that are unroadworthy or being used outside the manufacturer's specifications. Towing over capacity meets both tests. If you crash while overloaded — even by a small amount — your insurer can refuse the claim entirely, including third-party property damage, leaving you personally liable for the full cost.

Can police weigh my caravan on the road?

Yes. State transport inspectors and police operate portable weigh pads on major touring routes — the Hume, Pacific, Bruce, Stuart and Forrest highways are well-known enforcement spots, particularly during school holidays and Easter. They can also direct you to a fixed weighbridge. Refusing to weigh is itself an offence.

Can I increase my towing capacity?

Sometimes — but not directly. The braked tow rating on your compliance plate is fixed by the manufacturer. A GVM or GCM upgrade can give you more payload to actually use your existing tow rating within your limits, but it doesn't raise the tow rating itself. A handful of vehicles (Ford Ranger, LandCruiser 79/300, D-Max, Patrol Y62) have engineered second-stage manufacturer GCM upgrades available.

How much over capacity is enough to get fined?

Any amount. Under Australian mass-limit law, 1 kg over your GVM, GCM, ATM, axle load or tow ball rating is technically an offence. In practice, the HVNL tiers fines: under 5% over is 'minor' ($200–$500), 5–20% is 'substantial' ($1,000–$2,500), and over 20% is 'severe' ($3,000–$10,000+ and court).

What's the difference between towing capacity and GCM?

Braked towing capacity is the heaviest trailer your vehicle is rated to pull, checked against the trailer's ATM. GCM is the maximum combined weight of the loaded vehicle plus the loaded trailer. Many vehicles can't tow their maximum rating when fully loaded without going over GCM: a 2026 Ford Ranger XLT rated to 3,500 kg can tow about 3,460 kg once it's loaded to its GVM.
